- The State of Idaho has encountered and is about to encounter difficulties with the Federal Government in administering the trust of endowment lands granted by Congress for the support of common schools and for the support of other specified institutions, 26 Sta. 215 (1890), as amended. These grants constitute a trust of the highest, most sacred order which require the State of Idaho to act as trustee and administer the lands for the benefit of the designated beneficiaries, United States v. Fenton, 27 F.Supp. 8i6 (D.Ida. 1939). The difficulties have been created by recent Congressional legislation, principally the Wild and Scenic Rivers Act, 82 Stat. 906. Specifically, this act poses a challenge to State ownership of the beds of navigable rivers which was established by the cases of Pollard v. Hagan, 3 How. 212 (1845) and Scott v. Latti , 227 U.S. 229 (1912). Other difficulties involving the use of State land have also arisen because of this legislation.
